FDA Food Traceability Compliance Deadline Extended to July 2028
The FDA has proposed a 30-month extension to the compliance date, moving it from January 20, 2026 to July 20, 2028. This extension was further reinforced by the Continuing Appropriations, Agriculture, Legislative Branch, Military Construction and Veterans Affairs, and Extensions Act of 2026, which directed the FDA not to enforce the Food Traceability Rule prior to that date. The FDA has stated it intends to comply with this Congressional directive.
Does This Mean You Can Wait?
Not necessarily. While the extended timeline does provide welcome breathing room, the underlying requirements have not changed. Businesses that deal with foods on the Food Traceability List (FTL) — including cheese, eggs, fresh produce, fish, crustaceans, shellfish, and fresh prepared meals — will still need to implement systems for:
- Lot-level tracking and reporting at each Critical Tracking Event (CTE)
- Maintaining Key Data Elements (KDEs) linked to Traceability Lot Codes (TLCs)
- Developing a formal Traceability Plan
- Providing records to the FDA within 24 hours upon request
For many organizations, achieving full compliance will require significant changes to supply chain processes, data infrastructure, and technology. Starting early means more time to test, train, and course-correct before the deadline arrives.
One Notable Exemption Update
As of February 2026, cottage cheese has been granted a specific exemption from the Food Traceability Rule, following a Federal Register notice. Businesses handling cottage cheese should verify whether this exemption applies to their specific operations.
